General Terms and Conditions (T&Cs)

Scope of Application
These General Terms and Conditions govern the contractual relationship between Hundeglück Zillertal, operated by Anna Troppmair, Hollenzen 76, 6290 Mayrhofen, and the service recipient (customer). They apply to all offers and events for which Hundeglück Zillertal, Anna Troppmair, is responsible.
Conditions contrary to or deviating from these General Terms and Conditions of the service recipient are not applicable. By signing up, the customer acknowledges these General Terms and Conditions as binding. The current version of the General Terms and Conditions applies at the time of reservation.

Reservation / Registration
Reservations from the service recipient can only be made in writing (via SMS/WhatsApp at 0660 38 93 555 or via email at info@hundeglueck-zillertal.com) with complete details of the dog's owner (name, address, phone number) and the dog to be cared for. The reservation becomes binding only after the payment of the deposit via online transfer.
Once the deposit is received, the service recipient will receive a reservation confirmation in writing (email) from Anna Troppmair.
Upon contract conclusion, Anna Troppmair is committed to providing the contracted service at the agreed-upon time.
The number of care spots is limited. Reservations are considered in the order of their arrival. If overbooked, the inquiring party will be informed immediately.

Payment / Due Date
All price indications are gross prices.
Services must be paid 7 days before the agreed date via online transfer.
For short-term reservations (1-2 days before the start of the care), the full amount must be transferred to the company account on the same day or paid in cash on-site. In the case of short-term payments, a copy or screenshot of the bank's payment confirmation must be provided.

Withdrawal / Cancellation / Cancellation of Care
To guarantee the structured daily routine for the dogs, timely arrival is requested. The arrival time is always agreed upon in advance. If this is not possible or the appointment cannot be kept, early notification is required.
This does not apply if the service recipient provides a paying replacement customer.
The participant can withdraw from the registration for day care free of charge up to 48 hours before the start (cancellation), in writing (WhatsApp/SMS/Email).
For the deadline, the receipt of the statement in writing is decisive.

In case of a shorter-term cancellation, failure to appear without notice, or termination of care by the customer, Anna Troppmair is entitled to charge 100% of the costs for the service.
Changes to the reservation are only possible up to 7 days before the start of the care. Due to the limited number of care spots, a short-term rescheduling is not possible.

Service Provider's Withdrawal
Aggression: Anna Troppmair is entitled to refuse care for a dog that exhibits aggression toward her or other dogs. A written, transparent, detailed, and honest declaration about “behavioral issues” is mandatory on the registration form. If this is not provided, Anna Troppmair reserves the right to refuse care for the dog.
Illness: If the appointment is canceled by the organizer due to illness or other reasons related to the dog, the already paid invoice amount will, of course, be refunded.
Heat: Female dogs in heat will not be accepted for care. In case of heat, early cancellation of the dog care is requested. The already paid invoice amount will, of course, be refunded. If a female dog goes into heat during the care, she will be separated from the care group, and the service recipient must cover the additional costs for individual care.
For any expenses or other disadvantages caused by a cancellation or rescheduling, Anna Troppmair is not liable unless there is intent or gross negligence.

Exclusion
Dogs that are not socialized, bully other dogs in the care group, disturb neighbors by unnecessary barking, or do not respond to educational measures will be excluded from care. Dogs with contagious diseases, flea infestations, or other health issues that could affect the other dogs will also be excluded. No refund of the paid fee will be provided in such cases. The dog owner must immediately organize the dog’s pickup. If the dog owner cannot do this, Anna Troppmair will arrange alternative accommodation or charge additional costs for individual care. The costs will be borne by the dog owner.
Dogs that are not vaccinated, dewormed, or microchipped will not be accepted for care. A copy or photo of the EU pet passport must be provided.
The registration form, which is attached before the care service, must include a detailed and truthful declaration of any previous medical incidents, diseases, or other conditions before care.
An additional fee is required for unneutered male dogs due to extra cleaning efforts.

Liability
Liability of Anna Troppmair is excluded unless it is based on intent or gross negligence. In case of a breach of an essential contractual obligation, liability is limited to the typical, foreseeable damage.
The handover of the dog for care is at the owner’s own risk. By making a reservation, the participant acknowledges that Anna Troppmair operates in compliance with animal care regulations, and the welfare of the animals is the priority.
Anna Troppmair assumes no liability for injuries, disturbances, or damages caused by animals (e.g., ticks, insects, other dogs, etc.). The service recipients are explicitly warned of the possibility of such injuries or disturbances.
In case of the death of an older or sick dog, Anna Troppmair does not assume responsibility or liability. The service recipient will be contacted directly, and further measures will be discussed.
The dog groups are matched based on compatibility, and the dogs are often calm and balanced due to the pack behavior and structured daily routine. However, it is pointed out that they are animals and may not always be predictable in every situation.
Anna Troppmair is not liable for the behavior of dogs before, during, or after the care.
No liability is assumed for damage, theft, or loss of personal belongings (e.g., toys, blankets, beds), equipment, or clothing.
No liability is assumed for accompanying pets or items, nor for persons, especially for unattended children, in case of accidents, loss, or damages, including those caused by private dogs, theft, or other reasons.
Access to the premises, use of the facilities, handling of the dogs, and walks all occur at the owner’s own risk. This applies to the premises at Hollenzen 76, 6290 Mayrhofen, walks in the vicinity, and any other events for which Anna Troppmair is responsible.
In case of an accident, the insurance may be void. Anna Troppmair is not liable in this case.
Parents are liable for their children.
Dog owners are liable for their dogs.

Indemnity
The service recipient indemnifies Anna Troppmair from all claims by third parties or authorities arising from intentional or negligent breaches of duty by the service recipient. Anna Troppmair reserves the right to share personal data in this case. -
Supervision
Dogs are constantly supervised during care hours. If tensions or disputes arise, these will be defused/handled.
Anna Troppmair values pack care. Packs may be split if there are compatibility issues. If a dog is not compatible with others, this information must be provided before the care begins. Individual care is only possible by prior arrangement and incurs additional costs.
At night, the dogs stay in the dog rooms. Care dogs can sleep in boxes or on dog beds by arrangement. Every care dog has access to a dog box. These boxes are provided by Anna Troppmair. Dog beds from Lilipet can also be provided upon request. The service recipient may also bring their own dog beds or blankets. The dogs will receive fresh water daily and the food provided by the service recipient.
Once the dog owner is on-site, they are responsible for their dog.

Nutrition / Hygiene
The participant agrees that the dog's nutrition and hygiene will be kept at a basic level. The service recipient must provide the dog's food (food, sleeping places, treats, etc.). There is the option to order dog food for the duration of the care from Apollo's Finest and have it delivered to the care service. The costs will be borne by the service recipient.
If there is insufficient food, Anna Troppmair will provide it, and the service recipient must pay for this at the end of the care.

Force Majeure
For the safety of all dogs, Anna Troppmair may deviate from the planned care in the event of force majeure (accident, flea infestation, sudden contagious illness of a dog, etc.) or temporarily or permanently terminate the care. The health of the dogs always takes priority. -
Personal Data of the Service Recipient
Each service recipient agrees to provide a registration form with their data during the initial registration. The data in this form will be stored according to data protection laws and will not be shared with third parties. The data must be provided truthfully. -
Publication of Photo Material
To actively maintain public relations, photos and videos of the work will be used. Pictures of the dogs (including their names) will be shown on the website, Facebook page, Instagram, or in a newspaper article. By agreeing to this, the service recipient grants permission for the use of photo and video material for the above purposes. This consent is given on the registration form and can be withdrawn or denied at any time. -
Private Dogs “Lilly” and “Hugo” and Possibly Foster Dogs
Anna Troppmair has private dogs and sometimes foster dogs. These may only be petted or touched with explicit permission and in the presence of Anna Troppmair. Feeding the dogs is prohibited. It is also not allowed to reprimand or train other care dogs.
During dog care, private dogs Lilly and Hugo, as well as foster dogs, are included in the care pack. If there is incompatibility, these dogs will be separated and kept in Anna Troppmair’s private apartment. Access to this apartment is not allowed for care dogs.
Integration with the care dogs will only be done by Anna Troppmair if compatibility is established. If compatibility is not present, the dogs will be kept separate.

Applicable Law / Jurisdiction / Language of the Contract
The place of fulfillment is the location of Anna Troppmair. Austrian law applies.
The participant can only sue at the location of Anna Troppmair. For claims against other customers, legal entities of public or private law, or individuals who reside or have their habitual residence abroad or in a different legal district, the jurisdiction is the competent court at the location of the service recipient.
The language of the contract is German.
